Holiday homes and short-term rental tax

Our February issue looks at the ATO’s draft guidance on holiday homes and short-term accommodation, including the treatment of ownership costs and the distinction between private use and genuine commercial rental activity.

The article explores why advertised availability alone may not tell the whole story. Rental pricing, booking decisions and personal use during peak holiday periods all feature in the discussion. It also highlights the records owners can keep to help explain how their property is used.

Permanent incapacity and access to super

Superannuation is usually associated with retirement, but the newsletter also explains the permanent incapacity condition of release. It discusses how access to existing super savings differs from a claim under total and permanent disability insurance.

The feature considers supporting medical evidence, lump sums and income streams, and the importance of understanding the tax treatment before a payment is made. The appropriate next step depends on the member’s circumstances and their fund’s requirements.

Buying a new home before selling your existing home

An overlap between owning two homes can raise questions about the capital gains tax main residence exemption. This issue examines the limited overlap concession and the conditions that can affect its availability.

It also considers the interaction with the absence concession and what happens when the existing property is rented while awaiting sale. These examples show why the dates of purchase, occupation, rental and sale need to be considered together.

Six superannuation developments to watch

The February edition brings together six areas of change: the proposed Division 296 tax, payday super, expected contribution cap increases, the transfer balance cap, flexibility for certain legacy pensions, and fund performance and technology.

These articles reflect the position reported in February 2026. Some measures were still proposals or awaiting confirmation at that time, so the original discussion should be read in that historical context.
